La République du TCHAD étant membre de l’OACI, en tant qu’Etat contractant, l’utilisation des aérodromes Tchadiens est soumis au respect des normes et recommandations telles qu’elles sont définies dans la Convention relative à l’Aviation Civile Internationale et en son annexe 9 (exceptées les dispositions suivantes) :

The Republic of Chad as an ICAO member, as a state contracting, the use of Chadian aerodrome is subject to the respect of Standards and Recommendations as they are defined in the relative Convention on International Civil Aviation and in its Annex 9 (excepted the following provisions):

RÉGLEMENTANT L’ENTRÉE DES AÉRONEFSDU TERRITOIRE DU TCHAD

REGULATING THE ENTRY OF AIRCRAFT IN THE TERRITORY OF CHAD

GÉNÉRALITÉS

GENERAL

Article 1

Les aéronefs commerciaux étrangers desservant les lignes aériennes régulières intéressant le territoire tchadien conformément à des accords bilatéraux ou multilatéraux de transport aérien entre la République du TCHAD et l’Etat d’immatriculation de l’aéronef ne sont astreints pour le survol du territoire tchadien ou pour l’atterrissage sur un aérodrome douanier de ce territoire, à fournir aucun préavis autre que celui constitué par le plan de vol.

The foreign commercial aircraft performing scheduled air services within the Chadian territory in accordance with bilateral or multilateral air transport agreements between the Republic of Chad and the aircraft registration State are not compelled for some operations of Chadian territory overflying or landing on a customs aerodrome in this territory, to provide notice another one that only the one constituted by the flight plan.

Sous réserves de réciprocité, les mêmes facilités sont accordées aux aéronefs des compagnies nationales de transport aérien des Etats signataires de la Convention de Saint-Louis (1).

Subject to reciprocity, the same facilities are granted to aircraft belonging to national transport airlines of States signing the Convention of Saint Louis (1).

Article 2

Tous les vols au-dessus du territoire du TCHAD et les atterrissages sur ces aérodromes devront être effectués conformément aux réglements tchadiens concernant l’Aviation Civile et notamment ceux fixés pour le survol des zones désertiques.

Every flight above the territory of Chad and landings on these aerodromes should be performed in accordance with the Chadian regulations concerning Civil aviation and notably those specified for the desert zone overflight.

Tout aéronef utilisant un aérodrome du TCHAD doit obligatoirement effectuer le premier atterrisage ou le dernier décollage sur l’un des aéroports douaniers suivants :

All aircraft operating on an aerodrome of Chad must perform the first landing or the final take-off inevitably from one of the following customs airports:

Article 3

Escale commerciale d’une ligne commerciale régulière.

Commercial stop of commercial scheduled service

Toute escale commerciale d’un ligne commerciale régulière ne peut être accordée que dans le cadre d’un accord bilatéral ou multilatéral de transport aérien.

All commercial stop of commercial scheduled service cannot be allowed that in accordance with a bilateral or multilateral air transport agreement.

Pendant la durée des pourparlers un accord provisoire pourra être conclu.

During the time of negotiations, a temporary mutual agreement will be concluded.

Article 4

Survol et escale technique par une ligne commerciale régulière.

Overflight and technical stop performed by a commercial scheduled service

L’établissement d’une ligne commerciale régulière au-dessus du territoire tchadien (avec ou sans escale technique) doit faire l’objet d’un note adressée par la voie diplomatique au Ministre des Affaires Etrangères de la République du TCHAD. Cette note devra parvenir à son destinataire au moins quinze jours avant le premier vol envisagé.

The establishment of a commercial scheduled service over the Chadian territory (with or without technical stop) must be the object of a note addressed by diplomatic way to the Ministry of Foreign Affairs of the Republic of Chad. This note should arrive to its recipient at least fifteen days before the first expected flight.

Toute modification apportée à l’horaire ou à l’itinéraire d’une ligne commerciale régulière fera l’objet d’une note adressée au Ministère des Travaux Publics chargé de l’Aviation Civile au moins dix jours avant la modification envisagée.

All modification operated in the timetable or in the itinerary of a commercial scheduled service will be the object of a note addressed to the Ministry of Public Works in charge of Civil Aviation at least ten days before the expected modification.

Article 5

Survol et escale technique

Overflight and technical stops

Si un exploitant appartenant à un Etat membre de l’OACI, a l’intention d’efectuer avec un aéronef civil un ou plusieurs vols non réguliers en transit à travers le territoire du TCHAD ou d’y faire des escales techniques, il peut le faire sans être obligé d’obtenir l’autorisation préalable, hormis s’il appartient à un Etat qui n’accorde pas le même privilège aux aéronefs tchadiens.

If an operator belonging to a member state of ICAO, has the intention to operate with a civil aircraft one or several non scheduled flights in transit through the territory of Chad or to make in it technical stops, he can make it without being obliged to obtain a previous authorization, except if he comes from a State that doesn't grant the same privilege to Chadian aircraft.

Toutefois, il doit adresser, au Directeur de l’Aéronautique Civile, par la voie qu’il jugera appropriée, un préavis de vol qui devra parvenir à son destinataire soixante douze heures ouvrables au moins avant la date projetée pour l’opération. Le préavis, rédigé en français, doit comprendre les renseignements suivants :

However, he must address to the Director of Civil Aviation, by the way that he will judge suitable, a flight notice that should arrive to the recipient at least sixty twelve working hours before the expected date for the operation. The notice prepared in French, must include the following information :

Nom et adresse de l’exploitant ;

Name and address of operator;

Type et marques d’immatriculation de l’aéronef ;

Type and registration marks of aircraft;

Date et heure de départ de l’aérodrome considéré ;

Date and departure time from the expected aerodrome;

Lieu ou lieux d’embarquement et de débarquement du chargement

Place or places of cargo embarkation and disembarkation;

Objet du vol, nombre et nationalité des passagers, nature et quantité de frêt ;

Flight purpose, number and nationality of passengers, nature and quantity of cargo;

Nom, prénoms et nationalité du pilote et des membres d’équipage ;

Names and nationality of pilot-in command and crew members;

Nom, adresse et profession de l’affrêteur le cas échéant.

Name, address and profession of freighter if necessary.

Article 6

Si un exploitant appartenant à un Etat membre de l’OACI, désire effectuer avec un aéronef civil, un ou plusieurs vols non réguliers commerciaux, ildoit en demander l’autorisation au Ministre chargé des Transports. La demande, rédigée en français, devra parvenir à son destinataire dix jours avant la date envisagée pour le vol et comporter les mêmes renseignements que ceux prévus à l’article 5 ci-avant.

If an operator belonging to a member state of ICAO, has the intention to operate with a civil airship, one or several non scheduled commercial flights, he must address a request for authorization to the Minister in charge of Transport. The request, prepared in French, should arrive to the recipient ten days before the date expected for the flight and should include the same information that those specified in Article 5 mentioned before.

PRIVATE FLIGHTS

Article 7

Les aéronefs constituant l’aviation générale sont soumis aux mêmes règles que celles prévues à l’article 5 ci-avant pour les vols non réguliers des aéronefs commerciaux.

The aircraft constituting general aviation are submitted to the same rules than those specified in Article 5 mentioned before for non scheduled flights of commercial aircraft.

RESTRICTIONS

Article 8

Toute restriction momentanée qui viendrait à être apportée au présent décret sera portée à la connaissance des navigateurs aériens par NOTAM.

All temporary restriction that would come to be brought to the present decree will be carried to the pilots information by NOTAM.

En particulier, le bénéfice des facilités accordées dans les articles qui précèdent pourra être retiré provisoirement aux aéronefs d’un Etat contre lequel de telles mesures auront été décidées soit par un organisme inter-Africain si le TCHAD s’est associé à cette décision soit par le Conseil des Ministres pour des questions de sécurité.

In particular, the benefit of facilities allowed in the articles that precede can be retired temporarily to aircraft of a State against which such measures will have been decided either by an African organism if Chad is associated to this decision, or by the Council of Ministers for security reasons.

Dans l’esprit du présent article, le décret 179 du 26 septembre 1963 reste en vigueur.

In the spirit of the present article, the decree 179 of September 26th, 1963 remained in force.

OTHER FLIGHTS

Article 9

Si un Etat membre de l’OACI désire effectuer un survol du territoire ou une escale technique sur un aérodrome tchadien avec un aéronef militaire ou d’Etat, il devra en formuler la demande par le voie diplomatiqu. Cette demande rédigée autant que possible en langue française, devra être adressée au Ministère des Affaires Etrangères au moins quinze jours avant l’opération projetée, elle devra obligatoirement contenir les renseignements suivants :

If an ICAO member state wants to operate an overflight of the territory or a technical stop on a Chadian aerodrome with a military or state aircraft, it should address the request for that by diplomatic way. This request prepared as much that possible in French language, should be addressed to the Ministry of Foreign Affairs at least fifteen days before the expected operation. The request must include inevitably the following information :

Type de l’aéronef ;

Type of aircraft;

Immatriculation ;

Registration marks;

Désignation de l’armée ou service auquel appartient l’aéronef;

Designation of army or service to which belongs the aircraft;

Nombre, nationalité et qualité des passagers ;

Number, nationality and quality of passengers;

Nature du chargement ;

Nature of cargo;

Motif du vol ;

Flight purpose;

Itinéraire complet de l’appareil y compris le voyage de retour;

Complete route of aircraft including the return trip;

Dates prévues de survol et d’atterrissage.

Dates expected for overflight and landing.

ÉTATS NON MEMBRES DE L’O.A.C.I.

NON MEMBER STATES OF ICAO

Article 10

Tous les Etats non membres de l’OACI devront, pour être autorisés à effectuer des vols commerciaux non réguliers, des vols privés et des vols avec leurs aéronef d’Etat ou militaires, en faire la demande dans les mêmes conditions et dans la même forme que prévu à l’article 9.

All non member states of ICAO will have, to be allowed to operate non scheduled commercial flights, private flights and flights with state or military aircraft, to address a request for authorization in the same form and conditions specified in Article 9.

INSPECTIONS

Article 11

Les aéronefs visés aux articles 5, 9 et 10 pourront être soumis à inspection, les autorités compétentes se réservant le droit de s’assurer que la cargaison correspond aux renseignements figurants dans la demande.

The aircraft referred to in Articles 5, 9 and 10 will be submitted to inspection, the competent authorities reserving the right to check that the cargo corresponds to the information indicated in the request.

Pour subir l’inspection prévue ci-dessus tout aéronef dûment autorisé à survoler le territoire pourra être contraint d’atterrir sur un aérodrome qui lui sera alors désigné.

To perform the inspection expected above, all aircraft duly authorized to operate the overflight, will be obliged to land on an aerodrome that will be then designated to it.

TAXES

Article 12

Tout survol du territoire tchadien et tout atterrissage sur l’un de ses aérodromes donnent lieu à perception de taxes.

All overflight above Chadian territory and all landing operating in one of its aerodromes give rise to the perception of charges.

L’Agence pour la Sécurité de la Navigation Aérienne en Afrique et à Madagascar est autorisée à percevoir ces taxes pour le compte du Gouvernement du TCHAD.

The Agency for Air Navigation Safety in Africa and Madagascar is allowed to discern these charges for the account of the Government of Chad.

Article 13

Les contrevenants au présent Décret seront poursuivis conformément à la loi.

The contraveners to the present Decree will be pursued in accordance with the law.

Article 14

Le Minstre des Travaux Publics chargé de l’Aéronautique Civile, le Ministre des Affaires Etrangères, le Ministre de la Défense Nationale, le Ministre de l’Intérieur, le Ministre de l’Economie, des Finances et des Transports, sont chargés de l’exécution du présent Décret qui sera communiqué partout où si besoin sera publié au Journal Officiel.

The Minister of Public Works in charge of Civil Aviation, the Minister of Foreign Affairs, the Minister of Nation Defence, the Minister of Home Office, the Minister of Economy, Finance and Transport, are in charge of the execution of the present Decree that will be diffused everywhere or if necessary will be published in the Official Journal.

RÉGLEMENTANT LA CIRCULATION DES AÉRONEFS PRIVÉS A L’INTÉRIEUR DU TCHAD

DECREE 1047/69-PR/TP/AC OF MAY 04th, 1970
REGULATING THE TRAFFIC OF PRIVATE AIRCRAFT WITHINTHE TERRITORY OF CHAD

Article premier

Article 1

Les aéronefs privés portant des marques de nationalité étrangère et basés provisoirement au TCHAD ainsi que les aéronefs privés portant les marques de la nationalité tchadienne sont soumis aux règles édictées ci-après pour leurs déplacements du départ de N’DJAMENA et à destination d’un aérodrome situé à l’intérieur du TCHAD.

The private aircraft having foreign registration marks and based temporarily in Chad as well as private aircraft having Chadian registration marks are submitted to the regulation stipulated below for their movements from the departure aerodrome of N'DJAMENA and at destination of an aerodrome situated inside of the territory of CHAD.

Article 2

Tout projet de déplacement des aéronefs privés désignés à l’article premier, doit faire l’objet d’un préavis de vol dont le modèle est annexé au présent arrêté et son dépôt effectué 24 heures ouvrables au moins auprès des services de police de l’aéroport de N’DJAMENA.

All movement project of private aircraft specified in Article 1, must be the object of a flight notice whose model is annexed to the present decree and its deposit be arrived at least 24 working hours to the immigration services of N'DJAMENA airport.

Le préavis de vol est indépendant du plan de vol qui doit être déposé au bloc technique de l’aéroport, conformément à la réglementation en vigueur.

The flight notice is independent of flight plan that must be registered in the technical block of airport, in accordance with the regulation in force.

Tous les départs auront lieu du parking situé face à l’aérogare

All flight departures will take place from the aircraft parking situated in face of the building terminal.

Article 3

Conformément à l’arrêté 08 TP/AC du 14 Mai 1968, les aéronefs privés monomoteurs ne sont pas autorisés à voler au Nord de la ligne Mao- Abéché.

In accordance with the Decree 08 TP/ACS of May 14th 1968, private single-engined aircraft are not allowed to fly beyond the North of Mao-Abeche line.

Article 4

Les aéronefs visés à l’article premier sont tenus de respecter les itinéraires définis à l’annexe 1 du décret 169 PR/TP du 19 Août 1966 fixant les conditions techniques d’exploitation des aéronefs dont le poids maximum au décollage n’excède pas 5.700 Kg.

The aircraft referred in Article 1 must to respect the routes specified in Annex 1 of Decree 169/PR/TP of August 19th 1966 fixing the technical conditions of aircraft operation whose the maximum take-off weight doesn't exceed 5.700 Kg.

Article 5

L’article 2 du présent arrêté ne s’applique pas, ni aux aéronefs d’Etat ni aux aéronefs de travail aérien, ces derniers restant soumis aux textes les ayant autorisé à effectuer le dit travail aérien.

The Article 2 of present Decree doesn't apply, neither to the state aircraft, nor to the aerial work aircraft, these last ones remaining submitted to the texts having to authorize them to operate aerial work.

Pour l’application des articles 3 et 4 ci-dessus, des dérogations pourront être accordées à la condition toutefois que le pilote soit détenteur de la licence de pilote professionnel “Avion”.

For the application of Articles 3 and 4 mentioned above, some derogations will be granted however under the condition that the pilot is in possession of professional "aircraft" pilot licence.

Article 6

Il est interdit aux aéronefs visés à l’article premier de se livrer à du transport de personnes contre rémunération, sous quelque forme que ce soit.

It is forbidden to aircraft referred in Article 1 to operate passengers transportation against remuneration, under any form.

Article 7

L’arrêté 1813 du 2 Août 1968 est abrogé.

The Article 1813 of August 2nd, 1968 is abrogated.

Article 8

Les contrevenants au présent arrêté seront poursuivis conformément à la loi.

The contraveners to the present Decree will be pursued in accordance with the law.

Les montants des redevances d’aérodromes et des services de navigation aérienne sont menitonnés à la page 14 GEN 4.3-01 et au sous sections GEN 4-1, GEN 4-2 et GEN 4-3 du Tome I “GÉNÉRALITÉS”

The amounts of charges for use of aerodromes and air navigation services are mentioned in page 14 GEN 4.3-01 and in Section GEN 4.1, GEN 4.2 and GEN 4.3 of Part I "GENERAL".
