GEN 1.2 Conditions d'autorisation de survol et d'atterrissage des aéronefs conditions of authorization of overflight and landing

CONDITIONS ET PROCEDURES A RESPECTER PAR LES EXPLOITANTS D'AERONEFS CIVILS ETRANGERS POUR L'OBTENTION DES AUTORISATIONS DE SURVOL ET D'ATTERRISSAGE EN REPUBLIQUE DU NIGER (Arrêté N°36/MPT/T/U/DAC du 20 Novembre 1976) CONDITIONS AND PROCEDURES TO BE RESPECTED BY OPERATORS OF FOREIGN CIVIL AIRCRAFT FOR THE OBTAINING OF AUTHORIZATIONS OF OVERFLIGHT AND LANDING IN REPUBLIC OF NIGER (Decree N°36/MPT/T/U/DAC of November 20th, 1976)


CHAPITRE PREMIER				CHAPTER I
GÉNÉRALITÉS				GENERAL

Article 1er				Article 1
Les aéronefs civils de nationalité étrangère ne peuvent effectuer des survols et ou des atterrissages en République du Niger que si ce droit leur a été accordé par une convention diplomatique multi - ou bilatérale ou s'ils reçoivent à cet effet une autorisation du Ministère des Travaux Publics, des Transports et de l'Urbanisme.				The civil aircraft of foreign nationality cannot operate some overflight and or landing in Republic of Niger that if this right has been granted them by a multi or bilateral diplomatic convention or if they receive at this proposal an authorization allowed by the Ministry of Public Works, Transport and Urbanism.

Article 2				Article 2
Pour tout survol du territoire nigérien avec ou sans escale, tout exploitant aéronef doit contracter une assurance aux tiers, ou fournir une caution, conformément à la législation en vigueur.				For all overflight of Niger territory with or without stopover, all operator aircraft must contract a third party insurance policy, or to provide a guaranty, in accordance with the legislation in force.

Article 3				Article 3
Tout aéronef en provenance ou à destination de l'étranger doit effectuer son premier atterrissage et ou sa dernière escale sur un aérodrome disposant des contrôles de douanes, de police et de santé.				All aircraft arriving from abroad or departing for a stranger country must operate his first landing and or his final departure on an aerodrome with customs, immigration and health control services.

Article 4				Article 4
Tout aéronef survolant le territoire de la République du Niger doit être muni des documents suivants :				All aircraft operating a flight over the territory of Niger Republic must be provided with the following documents :
	-	le certificat de navigabilité ou le laissez-passer de navigation, en cours de validité,			-	the airworthiness certificate or a navigation pass, under validity,
	-	le certificat d'immatriculation,			-	the registration certificate,
	-	les licences des membres d'équipage de conduite,			-	the licences of flight crew member,
	-	le carnet de route dit " Livre de bord ",			-	the flight register called " Air Book ",
	-	la licence de station de radio-communication de bord,			-	the licence of airborne radio communication station,
	-	la déclaration générale de chargement,			-	the general declaration of loading,
	-	un récépissé et des déclarations détaillées de chargement s'il transporte des marchandises.			-	a receipt and detailed declarations of loading if it transports some goods.

Article 5				Article 5
Les demandes d'autorisation de survol avec ou sans escale, doivent comporter en particulier les renseignements suivants :				The requests for overflight authorization with or without stopover, must include the following information in particular:
	-	type et immatriculation de l'aéronef,			-	type and registration marks of aircraft,
	-	nom du pilote, Commandant de bord,			-	name of the pilot-in commander,
	-	nombre de passagers transportés,			-	number of passengers transported,
	-	itinéraire projeté comportant tous les aérodromes d'escale,			-	the expected route including stops aerodromes,
	-	date et horaire détaillés,			-	date and detailed time,
	-	motif du voyage et nature du chargement.			-	purpose of flight and nature of cargo

Les vols ne doivent être entrepris que lorsqu'une réponse favorable du MTP/T/U aura été donnée à la demande d'autorisation et reçue par le Commandement de bord de l'aéronef.				The flights must not be operated that only when a favourable answer from the MTP/T/U will have been given to the applicant of authorization and received by the aircraft pilot-in commander.

Article 6				Article 6
La notification d'un préavis de vol ou d'un plan de vol ne tient pas lieu de demande d'autorisation.				The notification of a flight notice or a flight plan notice doesn't be considered as an authorization request.

Article 7				Article 7
Pour des raisons de sécurité, le Gouvernement du Niger se réserve le droit d'imposer des itinéraires bien déterminés aux aéronefs, dit " itinéraires autorisés ".				For security reasons, the Government of Niger reserves the right to impose some specified routes to aircraft called " authorized routes ".

Article 8				Article 8
Les autorités Nigériennes se réservent le droit de refuser le ou les vols sollicités sur le territoire Nigérien.				The authorities of Niger reserve the right to refuse the flight or the flights expected over the Niger territory.


CHAPITRE 2				CHAPTER 2
AÉRONEFS EFFECTUANT DE VOLS NON COMMERCIAUX				AIRCRAFT OPERATING NON COMMERCIAL FLIGHTS

Article 9				Article 9
Les aéronefs privés immatriculés dans un Etat membre de l'OACI (Organisation de l'Aviation Civile Internationale) sous réserve des dispositions de l'article premier ci-dessus, doivent adresser au MTP/T/U, quatre (4) jours ouvrables à l'avance, une demande d'autorisation de vol comportant les renseignements cités à l'article cinq (5) du présent arrêté.				The private aircraft registered in a member state of ICAO (International Civil Aviation Organisation) under the reserve of arrangements of the Article 1 above, must address to the Ministry MTP/T/U, four (4) working days in advance, a request for a flight authorization including information mentioned in the Article five (5) of the present decree.

Article 10				Article 10
Les aéronefs privés immatriculés dans un Etat non membre de l'OACI ainsi que les aéronefs d'Etat, doivent obtenir l'autorisation du Ministère des Affaires Etrangères à la suite d'une demande formulée par voie diplomatique quatre (4) jours ouvrables à l'avance, et comportant les renseignements cités à l'article cinq (5) du présent arrêté.				The private aircraft registered in a state non ICAO member as well as the state aircraft; must obtain the authorization of Foreign Affairs Ministry, following a request addressed by diplomatic way, four (4) working days in advance, and including information mentioned in the Article five (5) of the present decree.


CHAPITRE 3				CHAPTER 3
AERONEFS EFFECTUANT DES VOLS COMMERCIAUX SECTION I : VOLS REGULIERS				AIRSHIPS OPERATING COMMERCIAL FLIGHTS SECTION I : SCHEDULED FLIGHTS

Article 11				Article 11
Les aéronefs effectuant des vols commerciaux réguliers et exploités par une entreprise appartenant à un pays signataire de l'Accord de Transit ou bénéficiant d'un droit équivalent en vertu d'un accord aérien bilatéral peuvent survoler le territoire Nigérien et y effectuer des escales non commerciales dans les conditions prescrites dans lesdits accords.				The aircraft operating scheduled commercial flights and performed by an enterprise belonging to a State being a party to the Transit Agreement or having profit from an equivalent right according to a bilateral air agreement, are authorized to fly over the territory of Niger and operate non commercial stopovers in the conditions prescribed in these agreements.
Dans les autres cas, une demande d'autorisation doit être formulée et obtenue par la voie diplomatique.				In the other cases, a request for authorization must be formulated and obtained by diplomatic way.

Article 12				Article 12
L'exploitation, avec des escales commerciales au Niger, d'un service régulier doit être effectuée sous couvert :				The scheduled service operation with commercial stops in Niger, must be operated under cover of :
	-	soit de dispositions contenues dans les Accords bilatéraux de transport aérien conclus entre le Niger et les pays étrangers dont relèvent les entreprises exploitantes,			-	either provisions contained in the air transport bilateral Agreements concluded between Niger and the foreign countries to which belong the operating enterprises,
	-	soit d'autorisations particulières du Ministère des Travaux Publics, des Transports et de l'Urbanisme.			-	either particular authorizations granted by the Ministry of Public Works, Transport and Urbanism.

Dans tous les cas, les programmes d'exploitation doivent être approuvés par le Ministère des Travaux Publics, des Transports et de l'Urbanisme.				In any case, the operation programs must be approved by the Ministry of Public Works, Transport and Urbanism.
A cet effet, une demande d'approbation, accompagnée des programmes détaillés (et du Formulaire I si l'exploitant demande à opérer pour la première fois au Niger), doit parvenir au Ministère des Travaux Publics, des Transports et de l'Urbanisme trente (30) jours au moins avant la date prévue pour le premier atterrissage.				For this purpose, a request for approval, accompanied with the detailed programs (and the Form I if the operator asks to operate for the first time in Niger), must reach the Ministry of Public Works, Transport and Urbanism thirty (30) days at least before the expected date planned for the first landing.
Toute modification à apporter à un programme déjà approuvé est soumise à approbation dans les mêmes conditions et suffisamment à l'avance.				All modification that is brought to an already approved program is subject to the obtaining of authorization under the same conditions and sufficiently in advance.

SECTION II : VOLS NON REGULIERS				SECTION II : NON SCHEDULED FLIGHTS

Article 13				Article 13
Les aéronefs effectuant des vols commerciaux non réguliers, et exploités par des entreprises appartenant à des pays ayant conclu des Accords aériens bilatéraux avec le Niger peuvent survoler le territoire Nigérien ou y effectuer des escales non commerciales dans les conditions prescrites dans lesdits Accords.				The aircraft operating non scheduled commercial flights and performed by some enterprises belonging to States having signed with Niger bilateral Air Agreement, are authorized to fly over the territory of Niger or operate in it non commercial stopovers in the conditions prescribed in these agreements.
Dans les autres cas, une demande d'autorisation doit être formulée et parvenir au Ministère des Travaux Publics, des Transports et de l'Urbanisme, quatre (4) jours ouvrables au moins avant la date prévue pour le premier atterrissage.				In the other cases, a request for authorization must be formulated and addressed to the Ministry Public Works, Transport and Urbanism, four (4) working days at least before the date planned for the first landing.

Article 14				Article 14
Pour l'exploitation de vols non réguliers, avec des escales commerciales, on distingue :				For the non scheduled flights operation with commercial stopovers, someone can distinguish :
	a)	Vols supplémentaires destinés à renforcer les services internationaux réguliers : les demandes d'autorisation établies en double exemplaire doivent parvenir au MTP/T/U quinze (15) jours au moins avant la date prévue pour le premier atterrissage.			a)	Additional flights assigned to intensify international scheduled services : the request for authorization established in duplicate copies must be addressed to MTP/T/U, fifteen (15) days at least before the date planned for the first landing
	b)	Vols d'affrètement pour des voyages à forfait (Inclusive Tours), répondant aux conditions suivantes :			b)	Charter flights for inclusive tours satisfying to the following conditions :
		1°)	Chaque voyage devra consister en un aller et retour,			1°)	Every travel should be a round trip,
		2°)	Le prix forfaitaire doit inclure le transport aérien et les prestations au sol pour toute la durée du voyage avec un séjour minimal de six (6) nuits d'hôtel au Niger,			2°)	The inclusive price must include the air transportation and the services in the ground during the whole travel with a minimal stay of six (6) hotel accommodation nights in Niger,
		3°)	Le prix du transport aérien doit rester inconnu du public,			3°)	The air transportation price must remain unknown to the public,
		4°)	Toute la capacité du ou des avions doit être utilisée aux seuls fins d'Inclusive Tours et aucune place ne doit être cédée à des tiers, que ce soit contre rémunération ou non.			4°)	The whole capacity of the plane or planes should be used only for the inclusive Tours purposes and no seat should be transferred to a third party, whether it is against remuneration or not.

Pour cette catégorie de vols non réguliers, les demandes d'autorisation sont adressées, par les transporteurs et non pas les affréteurs (agence de voyage, ou autres organismes) et accompagnées du Formulaire II dûment rempli et signé en double exemplaires.				For this category of non scheduled flights, the requests for authorization are addressed, by the carriers but not the freighters (travel agency or other organisms) and accompanied by the Form II duly completed and signed in duplicate copies.

Elles doivent parvenir au MTP/T/U dans les délais suivants au minimum :				They must arrive in the Ministry MTP/T/U according the following minimum time :
	-	pour les programmes de plus de trois (3) vols : trente (30) jours avant la date prévue pour l'exécution du premier vol,			-	for programs of more than three (3) flights : thirty (30) days before the expected date planned for the execution of first flight,
	-	pour les programmes de trois (3) vols : au moins quinze (15) jours avant la date prévue pour l'exécution du premier vol.			-	for programs of three (3) flights : fifteen (15) days at least before the expected date planned for the execution of first flight.

	c)	Vols occasionnels non programmés à l'avance ou pour des cas d'urgence : Les demandes d'autorisation doivent parvenir par lettre ou par message (Télex, Télégramme ou RSFTA) au Ministère des Travaux Publics, de Transports et de l'Urbanisme, quatre (4) jours ouvrables au moins avant la date prévue pour l'exécution du premier atterrissage :			c)	Occasional flights unplanned in advance or for emergency : The requests for authorization must arrive by mail or message (Telex, Telegram or AFTN) to the Ministry of Public Works, Transport and urbanism, four (4) working days at least before the expected date planned for the execution of first landing :

CHAPITRE 4 DISPOSITIONS FINALES				CHAPTER 4 FINAL ARRANGEMENTS

Article 15				Article 15
Sauf cas exceptionnel et justifié comme tel, toute demande non établie conformément aux dispositions du présent arrêté sera considérée comme nulle et non avenue.				Except exceptional case and case justified like that, all request non established in accordance with arrangements of the present decree will be considered like invalid, null and void.

Article 16				Article 16
L'arrêté N°20 MTP/T/U/DAC du 21 avril 1975 est abrogé.				The decree N°20 MTP/T/U/DAC of April 21st, 1975 is abrogated

Article 17				Article 17
Le Directeur de l'Aéronautique Civile est chargé de l'application du présent arrêté qui sera publié au Journal Officiel de la République du Niger.				The Director of Civil Aviation is charged for the application of present decree that will be published in the Official Journal of Niger Republic.


INTERDICTION DE SURVOL DE CERTAINES ZONES POUR LES AERONEFS DE TOURISME ET DE TRAVAIL AERIEN (Décret N°79-156/PCMS/MDN du 25 Octobre 1979)				OVERFLIGHT INTERDICTION OF SOME ZONES TO THE TOURISM AND AERIAL WORK AIRCRAFT (Decree N°79-156/PCMS/MDN of October 25th, 1979)

Article 1				Article 1
Sauf autorisation préalable du Ministère chargé de l'Aviation Civile, le survol et l'atterrissage à l'intérieur des zones citées ci-dessous est interdit aux aéronefs de tourisme et de travail aérien.				Except previous authorization granted by the Ministry in charge of Civil Aviation, the overflight and the landing within the belowmentioned zones is forbidden to the tourism and aerial work aircraft.
	A-	Toutes les zones des départements d'Agadès et de Diffa			A-	All zones of the Departments of Agadès and Diffa
	B-	Toute la zone Sud-Est du département de Niamey jusqu'à la frontière avec le Burkina Faso et le Bénin. (Cette zone est définie comme suit : à l'Est par le fleuve Niger de Niamey jusqu'à la frontière du Bénin, à l'Ouest par la route Niamey - Torodi - Fada N'gourma au Burkina Faso).			B-	the whole South-east zone of Niamey Department until the frontier with Burkina and Benin. (This zone is defined as follows: in the East by the Niger river from Niamey until the frontier of Benin, in the West by the road Niamey-Torodi- Fada N'gourma in Burkina Faso).

Toute demande de survol et d'atterrissage à l'intérieur des zones définies par l'article premier du présent décret devra obligatoirement parvenir au Ministère chargé de l'Aviation Civile au moins 96 heures ouvrables avant la date prévue du vol et doit comporter les renseignements suivants :				All overflight and landing request operated inside the zones defined by the Article 1 of present decree must arrive inevitably to the Ministry in charge of Civil A at least 96 working hours before the expected date planned for the flight and must include the following information :
	A-	Immatriculation et type de l'aéronef,			A-	Registration and type of aircraft,
	B-	Le nom et l'adresse du propriétaire,			B-	Name and address of owner,
	C-	Le nom du pilote,			C-	Name of pilot,
	D-	Le nombre et les noms des membres de l'équipage,			D-	Number and names of crew member,
	E-	Le nombre et les noms des passagers			E-	Number and names of passengers,
	F-	L'itinéraire précis du vol,			F-	the precise route of flight,
	G-	La date exacte du vol ,			G-	the correct date of flight,
	H-	Le motif.			H-	the flight purpose.

Article 3				Article 3
Toute demande qui ne sera pas conforme aux dispositions définies dans l'article 2 du présent décret sera considérée comme nulle et non avenue.				All request that won't be compliant with the arrangements defined in the Article 2 of present decree will be considered like invalid, null and void.
Le vol ne doit être entrepris que lorsqu'une réponse favorable du Ministère chargé de l'Aviation Civile aura été donnée à la demande et reçue par le pilote commandant de bord de l'aéronef				The flight must not be operated that only when a favourable answer from the Ministry in charge of Civil Aviation will have been given to the applicant and received by the aircraft pilot-in commander
La notification d'un préavis de vol ou d'un plan de vol ne tient pas lieu de demande d'autorisation.				The notification of a flight notice of flight or a flight plan notice doesn't be considered as an authorization request.
Toutefois, en cas de force majeure ou d'opérations de sauvetage aérien, l'autorisation de survol des zones énumérées à l'article premier résulte de l'accord verbal donné en phonie ou au sol par une autorité compétente de la Direction de l'Aviation Civile ou du centre de coordination de sauvetage de Niamey.				However, in cases of absolute necessity or air rescue operations, the overflight authorization of the zones enumerated in the Article 1 can be the result of a verbal agreement granted in telephony or in the ground by a concerned authority of the Directorate of Civil Aviation or the Search and Rescue Coordination Centre of Niamey.
Les compagnies pétrolières et minières titulaires de permis de recherche peuvent obtenir, après en avoir formulé la demande auprès du Ministre chargé de l'Aviation Civile, une autorisation permanente de survol et d'atterrissage à l'intérieur de leurs zones respectives de recherche. Pour le survol des zones qui ne sont pas comprises dans leur permis de recherche, ces compagnies se conformeront aux dispositions définies par les articles 1er et 2ème du présent décret.				The oil and mining companies titular of research permits can obtain, after having formulated a request for it to the Minister in charge of Civil Aviation, a permanent authorization of overflight and landing inside their respective zones of research. For flight over the zones that are not included in their permits of research, these companies will conform with arrangements specified in the Articles 1 and 2 of present decree.

Quiconque aura fait ou laissé circuler un aéronef dans des conditions contraires aux prescriptions des articles 2 et 3 du présent décret sera puni conformément aux dispositions pénales définies par les articles 93 et 94 de l'Ordonnance N° 77-14 du 28 juillet 1977 portant Code de l'Aviation Civile.				Anyone who will have made operate or circulate an aircraft in conditions contrary with the prescriptions of the Articles 2 and 3 of present decree will be punished in accordance with the penal arrangements specified in the Articles 93 and 94 of Order N° 77- 14 of July 28th 1977 relative to the Code of Civil Aviation.

Les Ministères des Travaux Publics, des Transports et de l'Urbanisme et de la Défense Nationale sont chargé chacun en ce qui le concerne de l'application du présent décret qui sera au Journal Officiel de la République du Niger.				The Ministry of Public Works, Transport and Urbanism and the Ministry of National Defence are each in what concerns it, in charge of the execution of present decree that will be published in the Official Journal of Niger Republic


LISTE ET CONDITIONS D'OUVERTURE DES AERODROMES INTERNATIONAUX (Arrêté N°030/MTP du 8 mai 1964)				LIST AND OPENING CONDITIONS OF INTERNATIONAL AERODROMES (Decree N°030/MTP of May 8th, 1964)

Article 1				Article 1
Les aéroports inscrits à l'article 2 ci-après sont désignés comme aéroports internationaux aux termes de l'article 10 de la Convention relative à l'Aviation Civile Internationale.				The airports prescribed in the Article 2 hereafter are designated as international airports according to the terms of Article 10 of the Convention on international Civil Aviation.

Un service de douane, de police et de santé est installé, aux heures des services réguliers et sur demande, sur l'aéroport suivant :				Aservice of Customs, Immigration and Health is provided, during the scheduled services hours and on request, on the following airport :
	-	NIAMEY			-	NIAMEY
Un service de douane, de police et de santé est installé sur demande sur les aéroports suivants :				A service of Customs, Immigration and Health is operating, on request, on the following airports :
	-	ZINDER			-	ZINDER
	-	AGADES			-	AGADES

Article 3				Article 3
L'ouverture de jour s'entend d'un quart d'heure avant le lever du soleil à un quart d'heure après le coucher du soleil.				The day opening means a quarter of hour before the sunrise to a quarter of hour after the sunset
Les contrôles sur demande ne peuvent avoir lieu que si les préavis suivants sont respectés :				The inspection on request cannot be provided that only if the following notices are respected:
	1°)	Préavis de deux heures, ou demande déposée avant 17 heures locales (pour les contrôles de nuit) à NIAMEY,			1°)	Notice of two hours, or request formulated before 17 H local time (for night inspections) in NIAMEY,
	2°)	Préavis de 12 heures à ZINDER et AGADES			2°)	Notice of 12 hours in ZINDER and AGADES.
Toutefois, lorsqu'il s'agit de demandes motivées par un déroutement pour incident technique ou pour des circonstances atmosphériques particulières, les usagers ne seront pas tenus d'observer ces préavis.				However, when it is about request motivated by a rerouting due for technical incident or for particular meteorological circumstances, the users won't be obliged to observe these notices.

Lorsque les services fonctionnent à la demande, de jour comme de nuit, le transport des fonctionnaires des douanes, de la police et de la santé incombe à la personne qui demande le contrôle.				When the services are working on request, night and day, the transportation of the civil servants of Customs, Police and Health is in charge of the person who asks for the inspection.
En ce qui concerne la vérification des marchandises par le service des douanes, les contrôles effectués en dehors des heures normales d'ouverture du bureau, ainsi que le dimanche et jours fériés donnent lieu au paiement des redevances suivant un barème établi par l'administration des Douanes.				With regard to the inspection of goods by the Customs service, the controls operated outside the normal hours opening office, as well as Sunday and holidays, lead to the payment of charge payable according to a rate established by the Customs administration.

Article 5				Article 5
Sur les aéroports ouverts à la circulation aérienne publique et qui ne sont pas classés aéroports internationaux, les représentants du Ministre chargé de l'Aviation Civile ou à défaut les autorités locales civiles ou militaires ont qualité :				On the airports opened to public air traffic and that are not appointed as international airports, the representatives of the Minister in charge of Civil Aviation or if absence the civil or military local authorities have quality :

	1°)	pour examiner les livres de bord et vérifier en particulier si les aéronefs en provenance de l'étranger ont fait récemment escale sur un aéroport international pour y remplir les formalités requises ;			1°)	to control the aircraft documents and to verify particularly if the aircraft coming from foreign country have operated lately stops on an international airport to perform the required formalities;

	2°)	dans le cas où un aéronef venant de l'étranger se poserait directement sur un de ces aéroports et y déchargerait tout ou partie de sa charge marchande, pour signaler l'infraction ainsi commise aux services de police, de douane et de santé les plus proches et prendre les mesures conservatoires nécessaires en attendant l'arrivée des services de contrôle.			2°)	in the case where an aircraft coming from a foreign country has landed directly in one of these aerodromes and would proceed the unloading of all or a part of its commercial cargo, to signal the infringement thus committed to the nearest Services of Customs, Police and Health and to take the measures of necessary conservatories while waiting for the control services arrival.

Article 6				Article 6
Les commandants de Cercle de Directeur de la Santé Publique, le directeur des Douanes, le Directeur de la Sûreté, le Directeur de l'Aéronautique Civile sont chargés, chacun en ce qui le concerne, de l'application de présent arrêté qui sera publié au Journal Officiel de la République du Niger.				The Circle Commanders of Public Health Directorate, the Director of Customs, the Director of Security, the Director of Civil Aviation are, each in what concerns it, in charge of the application of the present decree that will be published in the Official Journal of Republic of Niger.


REGLEMENTS CONCERNANT L'UTILISATION DES AEROPORTS				REGULATION CONCERNING AERODROME AVAILABILITY
