| I - | DISPOSITIONS GÉNÉRALES | | I - | GENERAL ARRANGEMENTS |
| 1 - | L'espace aérien au-dessus du Territoire de la République Centrafricaine,
conformément à l'article 1er de la Convention relative à l'Aviation Civile
Internationale dite "Convention de Chicago" signée le 7 Décembre 1944, relève de
la souveraineté nationale. | | 1 - | The airspace above the territory of Central African Republic, is
placed under the national sovereignty, in accordance with the article 1st to the
Convention on International Civil Aviation called " Convention of Chicago "
signed on December 7th, 1944. |

| 2 - | Tout aéronef effectuant un vol international et devant utiliser ou utilisant
un aérodrome national a l'obligation d'effectuer le premier atterrissage et le
dernier décollage en République Centrafricaine sur un aérodrome douanier, sauf
dérogation spéciale accordée par le Ministre de la Défense Nationale. | | 2.- | All aircraft operating an international flight and expecting to use
or using a national aerodrome has the obligation to perform the first landing
and the final take-off in Central African Republic from a customs aerodrome,
except special derogation granted by the Minister of Defence. |

| 3 - | Le survol du territoire centrafricain avec ou sans escale par les aéronefs de
nationalité étrangère est soumis à une autorisation préalable du Gouvernement
délivrée dans les conditions prescrites aux alinéas 4 et 5 ci-après. | | 3 - | The overflight of the Central African territory with or without
stopover by foreign nationality aircraft is submitted to a previous
authorization of the Government delivered in the conditions prescribed to the
following indents 4 and 5 below. |

| 4 - | Les autorisations de survol et d'atterrissage des aéronefs d'Etat ou Civils
étrangers sont délivrées par le Ministre de la Défense Nationale après avis du
Ministre des Transports de l'Aviation Civile des Postes et Télécommunications et
du Ministre de la Sécurité publique et de l'Administration du Territoire. | | 4 - | The overflight and landing authorization of State aircraft or civil
foreign aircraft are delivered by the Minister of Defence, after advice of the
Minister of Transport, Civil Aviation, Post and Communications and the Minister
of Public Security and Territory Administration. |

| 5 - | Les demandes d'autorisation doivent être adressées par télex, message-radio,
ou tous autres moyens jugés appropriés au Ministre de la Défense Nationale,
soixante douze (72) heures au moins avant la date projetée pour le vol, sauf
dérogation expresse accordée par le Ministre de la Défense Nationale. | | 5 - |
The requests for authorization must be addressed by telex, radio message, or
any others appropriate facilities to the Minister of Defence, at least seventy
two (72) hours before the expected date for the flight, except
express
derogation granted by the Minister of Defence.

| 6 - | Les demandes d'autorisation doivent comporter les renseignements suivants

| - | Numéro d'immatriculation et indicatif d'appel s'il y a lieu | | - | Registration marks and Call Sign if necessary |

| - | Nom et adresse de l'exploitant ou de l'affréteur | | - | Name and address of Operator or Freighter |
| - | Nom, nationalité du Commandant de bord et nombre des membres d'équipage | | - | Name, nationality of the Commander and number of crew
members |
| - | Objet du vol | | - | Flight purpose |
| - | Nature du chargement (nombre de passagers, poids et nature du fret, origine et
destination finale du chargement) | | - | Nature of loading (passengers number, weight and nature of cargo,
origin and final destination of freight) |
| - | Itinéraires prévus comportant les points d'entrée et de sortie et les
éventuels aérodromes d'escales. | | - | Expected routes including entry and exit way points and possible
stopover aerodromes. |

| 7 - | Le Ministre de la Défense Nationale fait parvenir sans délai les demandes au
Ministre de la Sécurité publique et au Ministre des Transports, de l'Aviation
Civile pour avis à formuler dans un délai de quarante huit (48) heures et au
Ministre des Affaires Etrangères pour information. | | 7 - | The Minister of Defence sends without delay the requests for
authorization to the Minister of Public Security and to the Minister of
Transport and Civil Aviation for advice to be formulated within forty eight (48)
hours and for information to the Minister of Foreign Affairs. |
| Le Ministre de la Défense Nationale transmet sa réponse au demandeur. | | | The Minister of Defence transmits the answer to the applicant. |

| 8 - | Le défaut de réponse du Ministre de la Défense Nationale dans un délai de
soixante douze (72) heures après la réception d'une demande vaut refus. | | 8 - | The absence of an answer from the Minister of Defence within
seventy two (72) hours after the receipt of a request means authorization
rejected. |

| A) | Vols commerciaux réguliers | | A) | Scheduled commercial flights |
| 9 - | Les aéronefs commerciaux étrangers desservant les lignes régulières
conformément à des accords bilatéraux de transport aérien entre la République
Centrafricaine et l'Etat d'immatriculation ne sont astreints, pour le survol et
l'atterrissage sur les aérodromes douaniers, à aucun préavis autre que celui
constitué par le plan de vol. | | | The foreign commercial aircraft operating scheduled flights in
accordance with bilateral air transport agreements between the Central African
Republic and the state of registration are not compelled, for the overflight and
the landing on customs aerodromes, to produce any notice another one that only
the one constituted by the flight plan. |

| B) | Vols commerciaux non réguliers (Charters) | | B) | Non-Scheduled commercial flights (Charters) |
| 10 - | Les demandes d'autorisation pour effectuer des vols commerciaux non réguliers
doivent être formulées par écrit et parvenir au Ministre de la Défense Nationale
au moins quinze (15) jours avant la date projetée pour le premier vol. Il devra
comporter outre les indications prévues à l'alinéa 6, les renseignements
suivants : | | 10 - | The requests for authorization to operate non-scheduled commercial
flights must be forwarded by letter and addressed to the Minister of Defence at
least fifteen (15) days before the expected date for the first flight. They
should include the following information, in addition to the indications
mentioned in the paragraph 6 : |

| - Nombre de vols à exécuter | | | - Number of flights to operate |
| - Tarifs de transport passagers ou fret | | | - Tariffs of passengers transportation or freight |

| - Origine, destination, nature et quantité de la marchandise. | | | - Origin, destination, nature and quantity of cargo. |

| C) | Aéronefs des Etats non Membres de l'OACI | | C) | Aircraft belonging to non Member ICAO States |
| 11 - | Les aéronefs appartenant à des Etats non Membres de l'Organisation de
l'Aviation Civile Internationale seront assujettis aux dispositions de l'alinéa
6 ci-dessus et selon la nature du vol envisagé aux dispositions des alinéas 5. 9
ou 10. | | 11 - | The aircraft belonging to the non members states of the
International Civil Aviation Organization will be subject to the arrangements of
the paragraph 6 above and according to the nature of the expected flight to the
arrangements of the paragraphs 5, 9 or 10. |

| III - | RESTRICTIONS | | III - | RESTRICTIONS |
| 12 - | Le bénéfice des facilités accordées conformément aux dispositions des alinéas
précédents pourra être retiré provisoirement ou définitivement aux aéronefs d'un
Etat sur décision du Gouvernement. | | 12 - | The benefit of facilities granted in accordance with precedent
paragraphs arrangements will be able to be withdrawn temporarily or definitely
to the aircraft of a State by decision of the Government. |
| Les Navigateurs seront avisés par la voie appropriée des décisions de
restriction. | | | The navigators will be informed by the appropriated way about the
restriction decisions. |

| IV - | SANCTIONS | | IV - | SANCTIONS |
| 13 - | Les infractions aux dispositions du présent Décret seront punies des peines
prévues par la législation en vigueur. | | 13 - | The infringements to the present Decree arrangements will be
punished with the sentences in accordance with the laws in force. |

| 14 - | Le présent Décret abroge toutes dispositions antérieures contraires. | | 14 - | The present Decree abrogates all contrary previous
arrangements. |
