OVERFLIGHT AND LANDING CONDITIONS APPLICABLE TO THE CIVIL AIRCRAFT AND TO THE STATE AIRCRAFT

Article 114 - ADMISSION D'AÉRONEFS ÉTRANGERSArticle 114 - FOREIGN AIRCRAFT ADMISSION
1.Les aéronefs immatriculés dans un Etat étranger ne peuvent exercer au BURKINA FASO d'activités contre rémunération qu'aux termes d'Accords ou de Conventions conclu entre le Gouvernement du BURKINA et l'Etat d'immatriculation ou aux termes d'une autorisation spéciale et temporaire accordée par le Ministre chargé de l'aéronautique civile.1.The aircraft registered in a foreign State are not allowed to operate activities against remuneration in BURKINA FASO that only in accordance with agreements or Conventions signed between the Government of BURKINA and the registration state or under the terms of a special and temporary authorization granted by the Minister in charge of Civil Aviation.
2.En l'absence d'accord, de convention ou d'autorisation prévoyant le genre d'activités envisagées, un aéronef immatriculé dans un Etat étranger doit pour entrer dans la République du BURKINA obtenir une autorisation préalable des autorités compétentes en formulant selon le cas considéré une demande d'autorisation à l'un des organismes suivants :2.In case of no agreement, no convention or authorization indicating the nature of expected activities, an aircraft registered in a foreign State must obtain, before coming in BURKINA Republic, a previous authorization of the responsible authorities while formulating according to the considered case, a request for authorization to one the following organisms :
a)Pour les aéronefs d'Etat :a)For state aircraft :
On entend par aéronef d'Etat, tout aéronef affecté exclusivement à un service public, tels que les aéronefs militaires, de Douane ou de Police ainsi que tout aéronef civil utilisé d'une manière permanente ou temporaire par un service public.It means by State aircraft any aircraft exclusively affected to a public service, as military, Customs or Police aircraft as well as any civil aircraft used by a public service on a permanent or temporary basis.
Les demandes de survol/atterrissage desdits aéronefs seront adressées par le canal diplomatique au Ministère des Affaires Etrangères, à charge de les acheminer auprès du Ministère de l'Intérieur et de la Sécurité (destinataire) qui y répondra après avis du Ministère de la Défense Nationale. Une ampliation de cette réponse sera transmise à la Direction de l'Aviation Civile (D.A.C) pour dispositions pratiques à prendre.The requests for overflight or landing for these aircraft will be addressed through diplomatic channel to the Ministry of Foreign Affairs, in charge to dispatch them to the Ministry of Home Office and Security (recipient) that will answer them after advice of the Ministry of Defence. A copy of this answer will be transmitted to the Directorate of Civil Aviation (D.A.C) for convenient arrangements to take.
Les demandes devront parvenir 7 jours ouvrables au moins avant la date d'arrivée prévue de l'aéronef au BURKINA.The request must be addressed at least 7 working days before the expected arrival date of the aircraft in BURKINA.
Le transport d'armes, munitions, unités armées et appareils photographiques n'est permis que sur autorisation spéciale. La demande visant l'obtention de cette autorisation doit être soumise quinze (15) jours ouvrables avant la date du vol projeté par le canal diplomatique.The transportation of weapons, munitions, armed military and photographic cameras are only permitted by special authorization. The request to obtain this authorization must be addressed through diplomatic channel fifteen (15) working days before the date of the expected flight.
b)Pour les aéronefs Civils :b)For civil aircraft :
Les demandes seront adressées :The requests will be addressed :
-Soit directement au Ministère chargé de l'Aviation Civile (D.A.C) ;-Either directly to the Ministry in charge of Civil Aviation (D.A.C);
-Soit au Ministère des Affaires Etrangères, à charge de les transmettre auprès du Ministère chargé de l'Aviation Civile (D.A.C).-Either to the Ministry of Foreign Affairs, in charge to dispatch them to the Ministry in charge of Civil Aviation (D.A.C).
Les demandes acheminées par des voies autres que celles du RSFTA seront adressées sept (7) jours ouvrables au moins avant la date d'arrivée prévue de l'aéronef au BURKINAThe requests dispatched by ways others that those of AFTN network will be addressed at least seven (7) working days before the expected arrival date of the aircraft in BURKINA
Les demandes acheminées par les voies du RSFTA devront parvenir 72 heures ouvrables avant la date d'arrivée prévue. Ce délai peut être réduit à 48 heures ouvrables lorsqu'ils s'agit de transport à des fins humanitaires ou en cas de nécessité impérieuseThe requests dispatched by AFTN network will be transmitted 72 working hours before the expected arrival date. This delay may be reduced to 48 working hours when they are concerning transport for humanitarian purposes or in case of imperative needs.
3.En ce qui concerne les aéronefs immatriculés dans un Etat Etranger qui désirent entrer dans la République du BURKINA aux fins de tourisme ou d'autres activités ne donnant pas lieu à rémunération, ainsi que tous aéronefs immatriculés dans un Etat Etranger qui désirent seulement survoler le territoire de la République du BURKINA ou y faire des escales techniques, ces aéronefs doivent sous réserve d'Accords internationaux ou de Conventions, se conformer à la présente ordonnance en fournissant les renseignements suivants sur leur demande :3.With regard to any aircraft registered in a foreign State that wants to come in BURKINA at the ends of tourism or other activities not remunerated, as well as any aircraft registered in a foreign State that wants only to fly over the territory of BURKINA Republic or to perform technical stopovers, these aircraft must to conform in accordance with international agreements or Conventions, to the present arrangement while providing the following information in their request :
a)
1-Type d'aéronefs ;
2-Immatriculation
3-Numéro du vol ou indicatif d'appel ;
4-Nom de l'exploitant et adresse ;
5-Propriétaire de l'aéronef (en cas d'affrêtement) ;
6-Nom et nationalité du command de bord ;
7-Nombre des membres d'équipage et nationalité ;
8-Itinéraire complet (départ, escales intermédiaires, arrivée/départ BURKINA, destination finale) ;
9-Chargement (nature et quantité du frêt, nombre de passagers) ;
10-Motif du vol
a)
1-Type of aircraft;
2-Registration Mark;
3-Flight number or Call Sign;
4-Name of Operator and address;
5-Aircraft Owner (in case of chartering) ;
6-Name and nationality of the aircraft commander ;
7-Crew Number, names and nationality ;
8-Complete routes (aerodrome departure, intermediate stopovers, arrival/departure aerodrome in BURKINA, final destination) ;
9-Cargo (nature and cargo quantity, passengers number)
10-Flight purpose
L’autorisation de survol/atterrissage qui leur sera ainsi délivrée ne dispensera pas de l'obligation d'atterrir sur un aérodrome international prévue à l'article 54.The overflight/landing authorization that will be delivered to them won't dispense the obligation to perform the first landing on an international aerodrome mentioned in the article 54.
b)Remplir les conditions fixées à l'article 67 ;b)Satisfy to the conditions mentioned in the article 67;
c)Se conformer aux dispositions des lois et règlements burkinabés en matières de douane, immigration, police et santé;c)Comply with the arrangements of Burkinabe laws and regulations about customs, immigration, police and health;
d)Etre assuré pour dommages aux tiers à la surface, conformément aux dispositions du titre V de la présente partie.d)Take out a third-party damage insurance on the surface, in accordance with arrangements of the title V of the present part.

ADMISSION D'AERONEFS ETRANGERSFOREIGN AIRCRAFT ADMISSION
1Tous les vols à destination, ou au-dessus du territoire du Burkina Faso doivent être effectués après obtention d'une autorisation de l'Agence Nationale de l'Aviation Civile (ANAC) du BurkinaFaso et conformément à la réglementation nationale.11.All flights into, over the territory of Burkina Fasoterritory shall be carried out in accordance with National Civil Aviation Agency of Burkina Faso(NCAA) after gaining authorization and in accordance with the national regulations.
2.Tout aéronef à destination du Burkina Faso doit effectuer son premier atterrissage en territoire burkinabè sur un aéroport international disposant des services de douane, de police et de santé. De même tout aéronef quittant le territoire burkinabè doit accomplir sa derniére escale sur un aéroport international en territoire Burkinabè disposant des services de douane, de police et de santé. (voir AD1.3).2.Any aircraft bound for Burkina Faso must make its first landing in Burkina Faso territory at an international airport with customs, police and health services. Similarly, any aircraft leaving Burkinabe territory must make its last stopover at aninternational airport in Burkinabe territory with customs, police and health services. (see AD 1.3).
3.L'aéronef, après avoir atterri à l'aéroport(comme mentionné au point 2 ci-dessus) ne pourra poursuivre sa route que si le commandant de bord a obtenu les autorisations douanières nécessaires.3.The aircraft, after landing at the airport (as mentioned in point 2 above) will only be able to continue its route if the captain has obtained the necessary customs authorizations.
4.Dans le cas où un aéronef est contraint d'atterrir dans un aéroport autre qu'un aéroport international, tel que désigné à la sous-section AD1.3 de la présente publication disposant des services de douane, de police et de santé, le commandant de bord doit immédiatement communiquer avec le fonctionnaire des douanes ou la police le plus proche. Dans tous les cas où ilest nécessaire d'envoyer un agent des douanes sur les lieux d'un atterrissage d'urgence, le transport de cet agent sera à la charge du propriétaire de l'aéronef concerné.4.In the event that an aircraft is forced to land at an airport other than an international airport, as designated in subsection AD 1.3 of this publication,which has customs, police and health services, the captain should immediately contact the nearest customs or police officer. In all cases where it is necessary to send a customs agent to the scene of an emergency landing, the transport of this agent will be at the expense of the owner of the aircraft concerned.
5.Aucun aéronef, y compris les aéronefs affectés à un service de transport aérien régulier, n'effectuera de vols à destination ou en transit sur le territoire du Burkina Faso si ce n'est conformément aux conditions ci-dessus.5.No aircraft, including aircraft assigned to ascheduled air transport service, shall conduct flights to or in transit through the territory of Burkina Faso except in accordance with the above conditions.
6.Les aéronefs des états membres de l'UEMOA peuvent circuler librement au-dessus du territoire du Burkina Faso et réciproquement, sous réserve d'observer la réglementation en vigueur au Burkina Faso.6.Aircraft from WAEMU member states may circulate freely above the territory of Burkina Faso and viceversa, subject to observing the regulations in force in Burkina Faso.
7.Les aéronefs n'ayant pas la nationalité d'un état membre de l'UEMOA ne peuvent circuler au-dessus du territoire du Burkina Faso que si ce droit leur est accordé par une convention internationale ou s'ils reçoivent à cet effet, une autorisation spéciale et/ou temporaire.7.The aircraft registered else where may only fly over the territory of Burkina Faso if they have been granted this right through an international convention or if they obtain a special and/or temporary authorization.
8.En l'absence d'accord, de convention ou d'autorisation prévoyant le genre d'activités envisagées, un aéronef immatriculé dans un Etat étranger doit, pour entrer au BURKINA FASO, doit obtenir une autorisation préalable des autorités compétentes en formulant selon le cas considéré une demande d'autorisation à l'un des organismes suivants :8.8.In the absence of agreement, convention or authorization providing for the type of activities envisaged, an aircraft registered in a foreign State must, to enter BURKINA FASO, must obtain prior authorization from the competent authorities by formulating according to in the case considered, a request for authorization from one of the following bodies:
8.1. Pour les aéronefs d'Etat :8.1. For State aircraft :
8.1.1. Si un aéronef d'Etat a l'intention d'effectuer une (série de) vol(s) non régulier(s) vers le Burkina Faso, il doit en faire la demande au Gouvernement du Burkina Faso à travers le canal diplomatique pour l'autorisation d'effectuer une telle opération avant l'atterrissage ou le survol prévu. La demande doit inclure les informations suivantes dans l'ordre indiqué ci-dessous :8.1.1. If a State aircraft intends to carry out a (series of) non-scheduled flight(s) to Burkina Faso, it must make a request to the Government of Burkina Faso through the diplomatic channel for the authorization to carry out such an operation before the planned landing or overflight. The request must include the following information in the order listed below:
(a)Nom de l'opérateur.(a)Name of the Operator
(b)Type d'aéronef et marques d'immatriculation.(b)Aircraft type and registration marks
(c)Date et heure d'arrivée et de départ duBurkina Faso.(c)Date, Time of arrival and departure from BurkinaFaso.
(d)Lieu ou lieux d'embarquement ou dedébarquement des passagers et/ou du fret, etc.(d)Passenger or cargo Boarding/unboarding place.
(e)Objet du vol et nombre de passagers et/ou nature et quantité de fret.(e)Purpose of the operation and numbers of passengers or/and cargo weight.
(f)Route à suivre.(f)Route to follow
(g)Un certificat attestant qu'aucun matériel de guerre, tel que des armes, des munitions, des explosifs (à l'exception des explosifs d'évasion/d'aide), des piéces pyrotechniques (à l'exception des cartouches de signal de pistolet), des matières fissiles nucléaires, des gaz ABC, du matériel et des matériaux photographiques (qu'ils soient installés ou non) des appareils électroniques autres que ceux requis pour le fonctionnement normal de l'aéronef ne sont transportés par l'aéronef.(g)A certificate attesting that no war material,such as weapons, ammunition, explosives (except escape/aid explosives), pyrotechnics (except pistol signal cartridges), nuclear fissile material, ABC gases, photographic equipment, and materials (whether installed or not) electronic devices other than those required for the normal operation of the aircraft are being transported by the aircraft.
8.1.2. Le transport d'armes, de munitions, unités armées et appareils photographiques n'est permis que sur autorisation spéciale. La demande visant l'obtention de cette autorisation doit étre soumise par le canal diplomatique.8.1.2. The transport of weapons, ammunition, armed units and cameras is permitted only with special authorization. The application for this authorization must be submitted through the diplomatic channel.
8.2. Pour les aéronefs Civils8.2. Civil aircraft
8.2.1. Vols Réguliers8.2.1. Regular flights
Pour les opérations de vols réguliers internationaux par des compagnies aériennes étrangéres à destination ou en transit au Burkina Faso, les exigences suivantes doivent être respectées :For international scheduled flight operations by foreign airlines to or in transit through Burkina Faso, the following requirements must be met :
(a)L'Etat de la compagnie aérienne doit étrepartie soit à l'Accord sur le transit des services aériens internationaux de 1944, soit à un accord bilatéral sur le transport aérien avec le gouvernement du BurkinaFaso ou doit avoir obtenu une autorisation spéciale envertu d'un accord ou d'un arrangement bilatéral.(a)The State of the airline must be a party either to the year 1944 Agreement on the Transit ofInternational Air Services, or to a bilateral air transport agreement with the Government of Burkina Faso or must have obtained a special authorization under a bilateral agreement orarrangement.
(b)La compagnie aérienne doit étre éligible poureffectuer les vols en vertu des dispositions d'unaccord bilatéral ou multilatéral auquel l'Etat de la compagnie aérienne et le Burkina Faso sont parties contractantes et doit avoir une autorisation d'exploitation pour opérer dans l'espace aérien du Burkina Faso. Les demandes de tels permis doivent être soumises au Directeur Général de l'ANAC du Burkina Faso au moins trois (03) mois à l'avance.(b)The airline must be eligible to operate the flights under the provisions of a bilateral or multilateral agreement to which the State of the airline and Burkina Faso are contracting parties and must have an operating authorization to operate in the airspace of Burkina Faso.Applications for such permits must be submitted to the Director General of ANAC Burkina Faso at least three (03) months in advance.
8.2.2. Vols non réguliers8.2.2. Non-regular flights (charter)
Si un opérateur a l'intention d'effectuer une (série de vols non réguliers vers le Burkina Faso dans le but de prendre ou de décharger des passagers, du fret ou du courrier, il doit en faire la demande par écrit (par l'intermédiaire de l'agent local/prestataire de services opérationnels agréé par l'ANAC pour opérateurs étrangers non réguliers) au Directeur Général de l'ANAC et obtenir l'autorisation préalable d'effectuer ces opérations au moins 72 heures ouvrables avant la date d'arrivée prévue.If an operator intends to carry out a (series of non-scheduled flights to Burkina Faso for the purpose of picking up or offloading passengers, cargo or mail, it must make the request in writing (by the intermediary of the local agent/provider of operational services approved by ANAC for non-regular foreign operators) to the Director General of ANAC and obtain prior authorization to carry out these operations at least 72 working hours before the date of expected arrival.
Ce délai peut étre réduit à 48 heures ouvrables lorsqu'il s'agit de transport à des fins humanitaires ou en cas de nécessité impérieuse 24 heures avant l'atterrissage prévu. La demande doit inclure les informations suivantes dans l'ordre indiqué ci-dessous :This period may be reduced to 48 working hours in the case of transport for humanitarian purposes or in the event of imperative necessity 24 hours before the planned landing. The request must include the following information in the order listed below:
a)Nom, adresse et nationalité de l'exploitant del'aéronef.(a)Name, address and nationality of the aircraft operator.
(b)Type d'aéronef, Nationalité et Marques d'immatriculation de l'aéronef.(b)Aircraft type, Nationality and registration marks of the aircraft.
(c)Indicatif d'appel de l'aéronef.(c)Aircraft call sign.
d)Date et heure d'arrivée et de départ du BurkinaFaso.(d)Date and time of arrival and departure from BurkinaFaso.
(e)Lieu ou lieux d'embarquement ou de débarquement à l'étranger selon le cas des passagers et/ou du fret.(e)Place or places of embarkation or disembarkation abroad depending on the case of passengers and/or cargo.
(f)Objet du vol et détails des passagers et/ou nature et quantité du fret.(f)Purpose of the operation and details regarding the passengers and/or nature and quantity of the cargo.
(g)Nom, adresse et entreprise de l'affrété, le caséchéant.(g)Name, address, and company of the charterer, ifapplicable.
(h)Route à suivre.(h)Road to follow.
(i)Toute autre information pouvant être requise par leDirecteur Général de l'Agence nationale de l'aviation civile.(i)Any other information that may be required by the Director General of the National Civil Aviation Agency.
NB : Le transport de métaux précieux, d'armes, de munitions de guerre, de marchandises dangereuses tel que les matériaux fissiles, radioactifs et infectieux nécessite une autorisation spéciale de l'état burkinabé.NB: The transport of precious metals, weapons, munitions of war, dangerous goods such as fissile, radioactive and infectious materials requires special authorization from the Burkinabe state.
9.Travail aérien9.Aerial work
Les exploitants de travail aérien ne peuvent effectuer des travaux sur le territoire burkinabé que s'ils détiennent une autorisation délivrée par l'Agence Nationale de l'Aviation Civile.Aerial work operators can only carry out their operations in Burkina Faso if they hold an authorization issued by the National Civil.
10.Aéronefs télépilotes10.Remotely piloted aircraft
Les aéronefs télépilotés évoluent dans l'espace aérien burkinabé conformément à la réglementation de l'aviation civile applicable au Burkina Faso.Remotely piloted aircraft operate in Burkinabe airspace in accordance with civil aviation regulations applicable in Burkina Faso.
10.1. Les aéronefs télépilotés d'une masse maximale au décollage supérieur à cent cinquante (150) kilogrammes doivent se conformer à la réglementation applicable aux aéronefs habités.10.1. Remotely piloted aircraft with a maximum take-off weight greater than one hundred and fifty (150)kilograms must comply with the regulations applicable to manned aircraft.
10.2. L'utilisation des aéronefs autonomes (aéronefs non habités ne permettant pas l'intervention d'un pilote en temps réel pour gérer le vol) est interdite.10.2. The use of autonomous aircraft(unmanned aircraft that do not allow the intervention of a pilot in real time to manage the flight) is prohibited.
10.3. Un aéronef télépiloté civil ne peut etre exploité pour des activités autres que le sport et le loisir au Burkina Faso que s'il est identifié par l'Agence nationale de l'aviation civile et qu'un certificat d'identification est délivré à son propriétaire ou à son représentant légal.10.3. A civilian remotely piloted aircraft can only be operated for activities other than sport andleisure in Burkina Faso if it is identified by the National Civil Aviation Agency and an identification certificate is issued to its owner or his legal representative.
10.4. Les aéronefs télépilotés d'Etat ne peuvent survoler ou atterrir sur le territoire du Burkina Faso que sur autorisation du Ministre chargé de l'aviation civile en collaboration avec les Ministres chargés des affaires étrangères, de la défense et de la sécurité.10.4 State unmanned aircraft may only fly over or land on the territory of Burkina Faso with the authorization of the Minister responsible for civil aviation in collaboration with the Ministers responsible for foreign affairs, defense and security.
