ADMISSION D'AERONEFS ETRANGERSADMISSION FOREIGN AIRCRAFT
1Tous les vols à destination, ou au-dessus du territoire du Burkina Faso doivent être effectués après obtention d'une autorisation de l'Agence Nationale de l'Aviation Civile (ANAC) du Burkina Faso et conformément à la réglementation nationale.1 All flights into, over the territory of Burkina Faso shall be carried out in accordance with National Civil Aviation Agency of Burkina Faso (NCAA) after obtaining authorization and in accordance with the national regulations.
2Tout aéronef à destination du Burkina Faso doit effectuer son premier atterrissage en territoire burkinabè sur un aéroport international disposant des services de douane, de police et de santé. De même tout aéronef quittant le territoire burkinabè doit accomplir sa dernière escale sur un aéroport international en territoire Burkinabè disposant des services de douane, de police et de santé. (voir AD1.3).2Any aircraft bound for Burkina Faso must make its first landing in Burkina Faso territory at an international airport with customs, police and health services. Similarly, any aircraft leaving Burkina Faso territory must make its final departure at an international airport in Burkina Faso territory with customs, police and health services. (see AD 1.3).
3Toutefois, certaines catégories d’aéronefs peuvent, en raison de la nature de leur exploitation, être exemptées par autorisation du Ministre chargé de l’aviation civile après avis des ministres chargés de la Défense, de la Sécurité et des Finances. Les dispositions sont prises pour que les services d’immigration, de sûreté aéroportuaire, de douane et de santé soient présents à cet aérodrome non douanier afin d’y effectuer des formalités y relatives.3However, certain categories of aircraft may, due to the nature of their operation, be exempted by authorization of the Minister responsible for civil aviation after consulting the Ministers responsible for Defense, Security and Finance. Arrangements are made for immigration, airport security, customs and health services to be present at this non customs aerodrome in order to carry out related formalities.
4Le dépôt d’un plan de vol est obligatoire pour tout vol au départ d’un aérodrome burkinabè sauf pour les vols locaux s’effectuant dans une zone de contrôle (CTR) et les aéronefs d’Etat burkinabè effectuant des vols opérationnels. Pour les aérodromes non dotés de service de télécommunications, le plan de vol déposé en air (AFIL) est considéré.4 The filing of a flight plan is mandatory for all flights departing from a Burkinabe aerodrome except for local flights operating in a control zone (CTR) and Burkinabe state aircraft carrying out operational flights. For aerodromes not equipped with telecommunications service, the flight plan filed in the air (AFIL) is considered.
5 L'aéronef, après avoir atterri à l'aéroport (comme mentionné au point 2 ci-dessus) ne pourra poursuivre sa route que si le commandant de bord a obtenu les autorisations douanières nécessaires.
5 The aircraft, after landing at the airport (as mentioned in point 2 above) will only be able to continue its route if the captain has obtained the necessary customs authorizations.
6 Dans le cas où un aéronef est contraint d’atterrir dans un aéroport autre qu’un aéroport international, tel que désigné à la sous-section AD 1.3 de la présente publication, disposant des services de douane, de police et de santé, le commandant de bord doit immédiatement communiquer avec le fonctionnaire des douanes ou la police la plus proche. Dans tous les cas où il est nécessaire d’envoyer un agent des douanes sur les lieux d’un atterrissage d’urgence, le transport de cet agent sera à la charge du propriétaire de l’aéronef concerné.
6 In the event that an aircraft is forced to land at an airport other than an international airport, as designated in subsection AD 1.3 of this publication,which has customs, police and health services, the captain should immediately contact the nearest customs or police officer. In all cases where it is necessary to send a customs agent to the scene of
an emergency landing, the transport of this agent will be at the expense of the owner of the aircraft concerned
7 Les vols de transport aérien commerciaux effectués par les aéronefs étrangers entre deux points situés sur le territoire national avec atterrissage (cabotage) sont interdits.
Toutefois, un exploitant aérien étranger peut être autorisé à effectuer un vol domestique sous le permis d'exploitation aérienne d'un exploitant national moyennant un contrat conformément à I ‘arrêté relatif aux autorisations d'affrètement. 		7 Commercial air transport flights by foreign aircraft between two points within the national territory with landing (cabotage) are prohibited.
However, a foreign air operator may be authorized to operate a domestic flight under the air operating permit of a national operator by means of a contract in accordance with the Order on Charter Authorizations.
8 Les aéronefs étrangers appartenant à des entreprises basées au Burkina Faso et utilisés pour des vols privés sur le territoire national doivent détenir une autorisation d'exploitation délivrée par I'ANAC.
8Foreign aircraft belonging to companies based in Burkina Faso and used for private flights on national territory must hold an operating authorization issued by ANAC.
9Les aéronefs étrangers utilisés aux fins d'effectuer des vols humanitaires sur le territoire du Burkina Faso doivent détenir une autorisation délivrée par I'ANAC. Cette autorisation peut être ponctuelle, temporaire ou permanente sur demande introduite auprès du Ministère en charge des Affaires Etrangères. L'autorisation est délivrée par le Directeur Général de I'ANAC après avis des ministères chargés de la Défense et de la Sécurité. Les aéronefs utilisés pour des vols humanitaires sur le territoire du Burkina Faso ne peuvent en aucun cas effectuer des vols contre rémunération.9Foreign aircraft used for humanitarian flights within the territory of Burkina Faso must hold an authorization issued by ANAC. This authorization may be one-off, temporary, or permanent upon request submitted to the Ministry of Foreign Affairs. The authorization is issued by the Director General of ANAC after consulting the Ministries of Defense and Security. Aircraft used for humanitarian flights within the territory of Burkina Faso may not under any circumstances carry out flights for remuneration.
10Tous les étrangers atterrissant sur un aéroport du Burkina Faso se font assister par un organisme d’assistance en escale agréé par l’ANAC conformément au RAF 06.4. Seules les compagnies aériennes nationales peuvent être autorisées conformément au RAF06.4 à pratiquer l’auto-assistance en escale sur un aéroport du Burkina Faso.10All foreigners landing at an airport in Burkina Faso are assisted by a ground handling agency approved by ANAC in accordance with RAF 06.4. Only national airlines may be authorized in accordance with RAF06.4 to carry out self-handling at an airport in Burkina Faso.
11 Aucun aéronef, y compris les aéronefs affectés à un service de transport aérien régulier, n'effectuera de vols à destination ou en transit sur le territoire du Burkina Faso si ce n'est conformément aux conditions ci-dessus.
11No aircraft, including aircraft assigned to a scheduled air transport service, shall conduct flights to or in transit through the territory of Burkina Faso except in accordance with the above conditions.
12 Les aéronefs des états membres de l'UEMOA peuvent circuler librement au-dessus du territoire du Burkina Faso et réciproquement, sous réserve d'observer la réglementation en vigueur au Burkina Faso.
12 Aircraft from WAEMU member states may travel peacefully above the territory of Burkina Faso and vice versa, subject to observing the regulations applied in Burkina Faso.
13 Les aéronefs n'ayant pas la nationalité d'un état membre de l'UEMOA ne peuvent circuler au-dessus du territoire du Burkina Faso que si ce droit leur est accordé par une convention internationale ou s'ils reçoivent à cet effet, une autorisation spéciale et/ou temporaire.
13The aircraft registered in a state else a WAEMU member state may only fly over the territory of Burkina Faso if they have been granted this right through an international convention or if they obtain a special and/or temporary authorization.
14 En l'absence d'accord, de convention ou d'autorisation prévoyant le genre d'activités envisagées, un aéronef immatriculé dans un Etat étranger doit, pour entrer au Burkina Faso, obtenir une autorisation préalable des autorités compétentes en formulant selon le cas considéré une demande d'autorisation à l'un des organismes suivants :
14 In the absence of agreement, convention or authorization providing for the type of activities envisaged, an aircraft registered in a foreign State must, to enter Burkina Faso, obtain prior authorization from the competent authorities by formulating according to in the case considered, a request for authorization from one of the following entities :
14.1Pour les aéronefs d'Etat :14.1 For State aircraft :
14.1.1 - La demande d’autorisation de survol, avec ou sans atterrissage, du territoire burkinabé par un aéronef d’Etat étranger doit émaner des services compétents de l’Etat concerné. Cette demande peut être ponctuelle, temporaire ou permanente et doit être introduite selon les procédures diplomatiques d’usage, soit auprès des représentations diplomatiques burkinabé à l’étranger soit directement auprès du ministère en charge des Affaires Etrangères. La demande doit inclure les informations suivantes dans l'ordre indiqué ci-dessous : 14.1.1 - The request for authorization to overflight, with
or without landing, Burkinabe territory by a foreign state aircraft must come from the competent services of the State concerned. This request may be one-off, temporary or permanent and must be submitted according to the usual diplomatic procedures, either to Burkinabe diplomatic representations abroad or directly to the Ministry of Foreign Affairs. The request must include the following information in the order indicated below:
a. Nom de l'opérateur ;
b. Type d'aéronef et marques d'immatriculation ;
c. Date et heure d'arrivée et de départ du Burkina Faso ;
d. Lieu ou lieux d'embarquement ou de débarquement des passagers et/ou du fret, etc ;
e. Objet du vol et nombre de passagers et/ou nature et quantité de fret ;
f. Route à suivre ;
g. Un certificat attestant qu'aucun matériel de guerre, tel que des armes, des munitions, des explosifs (à l'exception des explosifs d'évasion/d'aide), des pièces pyrotechniques (à l'exception des cartouches de signal de pistolet), des matières fissiles nucléaires, des gaz ABC, du matériel et des matériaux photographiques (qu'ils soient installés ou non) des appareils électroniques autres que ceux requis pour le fonctionnement normal de l'aéronef ne sont transportés par l'aéronef. 		a. Name of the Operator ;
b. Aircraft type and registration marks ;
c. Date, Time of arrival and departure from Burkina Faso ;
d. Passenger or cargo Boarding/unboarding place ;
e. Purpose of the operation and number of
passengers or/and cargo weight ;
f. itinerary to follow;
g. A certificate attesting that no war material,such as weapons, ammunition, explosives (except escape/aid explosives), pyrotechnics (except pistol signal cartridges), nuclear fissile material, ABC gases, photographic equipment, and materials (whether installed or not) electronic devices other than those required for the normal operation of the aircraft are being transported by the aircraft .
14.1.2. Le transport d'armes, de munitions, unités armées et appareils photographiques n'est permis que sur autorisation spéciale. La demande visant l'obtention de cette autorisation doit être soumise par le canal diplomatique.14.1.2. The transport of weapons, ammunition, armed units and cameras is permitted only with special authorization. The application for this authorization must be submitted through the diplomatic channel
14.2Pour les aéronefs Civils14.2Civil aircraft
14.2.1. Vols non réguliers
Une demande d'autorisation de survol ou d’atterrissage doit être déposée pour tout vol non régulier ou ponctuel.
Pour les vols privés, de transport de passagers, du fret ou du courrier, la demande doit parvenir par écrit (par l’intermédiaire de l’agent local/prestataire de services opérationnels agréés par l’ANAC pour opérateurs étrangers non réguliers) à I'Agence Nationale de I'Aviation Civile au moins trois (03) jours ouvrables avant la date prévue du vol.
14.2.1. Non-regular flights
An overflight or landing authorization request must be submitted for any non-scheduled or ad hoc flight.
For private, passenger, cargo, or mail flights, the request must be submitted in writing (through the local agent/operational service provider approved by ANAC for non-scheduled foreign operators) to the National Civil Aviation Agency at least three (03) business days before the scheduled flight date.

Pour les escales techniques, les vols d'évacuation sanitaire, humanitaires et de transport de dépouille mortelle, la demande peut être soumise dans un délai de moins de vingt-quatre (24) heures avant la date prévue du vol.
La demande doit inclure les informations suivantes dans l'ordre indiqué ci-dessous :
For technical stopovers, medical evacuation, humanitarian, and mortal remains transport flights, the request may be submitted less than twenty-four (24) hours before the scheduled flight date.
The request must include the following information in the order indicated below:
a) Nom, adresse et nationalité de l'exploitant de l'aéronef ;
(b) Type d'aéronef, Nationalité et Marques d'immatriculation de l'aéronef ;
(c) Indicatif d'appel de l'aéronef ;
(d) Date et heure d'arrivée et de départ du Burkina Faso ;
(e) Lieu ou lieux d'embarquement ou de débarquement à l'étranger selon le cas des passagers et/ou du fret ;
(f) Objet du vol et détails des passagers et/ou nature et quantité du fret ;
(g) Nom, adresse et entreprise de l'affrété, le cas échéant ;
(h) Route à suivre ;
(i) Toute autre information pouvant être requise par le Directeur Général de l'Agence nationale de l'aviation civile. 		(a) Name, address and nationality of the aircraft operator ;
(b) Type, Nationality and registration marks of the aircraft ;
(c) Aircraft call sign ;
(d) Date and time of arrival and departure from Burkina Faso ;
(e) Place or places of boarding/unboarding abroad depending on the case of passengers and/or cargo.
(f) Purpose of the flight and details of the passengers and/or nature and quantity of the cargo ;
(g) Name, address, and company of the charterer, if applicable ;
(h) Itinerary to follow.
(i) Any other information that may be required by the General Director of the National Civil Aviation Agency.

NB : Le transport de métaux précieux, d'armes, de munitions de guerre, de marchandises dangereuses tel que les matériaux fissiles, radioactifs et infectieux nécessite une autorisation spéciale de l'Etat burkinabé. NB : The transport of precious metals, weapons,
war ammunition, dangerous goods such as fissile, radioactive and infectious materials requires special authorization from the Burkina Faso state.
15Travail aérien15Aerial work
Les exploitants de travail aérien ne peuvent effectuer des travaux sur le territoire burkinabé que s'ils détiennent une autorisation délivrée par l'Agence Nationale de l'Aviation Civile conformément au RAF06.5. La demande de mise en place pour le travail aérien doit parvenir à l’Agence Nationale de l’Aviation Civile au moins trois (03) jours ouvrables avant la date prévue du démarrage des vols.
Aerial work operators may only carry out work on
Burkinabe territory if they hold an authorization issued by the National Civil Aviation Agency in accordance with RAF06.5. The request for establishment of aerial work must reach the National Civil Aviation Agency at least three (03) working days before the scheduled start date of flights.
16Aéronefs télépilotés16Remoted pilote aircraft
16.1Les aéronefs télépilotés d'une masse maximale au décollage supérieur à cent cinquante (150) kilogrammes doivent se conformer à la réglementation applicable aux aéronefs habités.16.1Remoted pilote aircraft with a maximum take-off weight over than one hundred and fifty (150) kilograms must comply with the regulations applicable to manned aircraft.
16.2 L'utilisation des aéronefs autonomes (aéronefs non habités ne permettant pas l'intervention d'un pilote en temps réel pour gérer le vol) est interdite.
16.2.The use of autonomous aircraft(unmanned aircraft that do not allow the intervention of a pilot in real time to manage the flight) is prohibited.
16.3Un aéronef télépiloté civil ne peut être exploité pour des activités autres que le sport et le loisir au Burkina Faso que s'il est identifié par l'Agence Nationale de l'Aviation Civile et qu'un certificat d'identification est délivré à son propriétaire ou à son représentant légal.1.6.3 A civilian remoted pilote aircraft can only be operated for activities other than sport and hobbies in Burkina Faso if it is identified by the National Civil Aviation Agency and an identification certificate is issued to its owner or his legal representative.
16.4 Les aéronefs télépilotés civils étrangers sont interdits de survoler l’espace aérien burkinabé. Toutefois, pour des activités d’intérêt public, le Directeur Général de l’Agence Nationale de l’Aviation Civile peut accorder une dérogation après avis des ministères en charge de la Défense et de la Sécurité.
16.4 Foreign civilian remoted pilote aircraft are prohibited from flying over Burkina Faso airspace. However, for activities of public interest, the General Director of the National Civil Aviation Agency may grant an exemption after consulting the ministries in charge of Defense and Security.
16.5Les aéronefs télépilotés étrangers d'Etat ne peuvent survoler ou atterrir sur le territoire du Burkina Faso que sur autorisation du Ministre chargé de l'aviation civile en collaboration avec les Ministres chargés des affaires étrangères, de la défense et de la sécurité.16.5 Foreign state-owned remotely piloted aircraft may only fly over or land on the territory of Burkina Faso with the
authorization of the Minister responsible for civil aviation in collaboration with the Ministers responsible for foreign affairs, defense and security.
ADMISSION D'AERONEFS ETRANGERS FOREIGN AIRCRAFT ADMISSION
1 Tous les vols à destination, ou au-dessus du territoire du Burkina Faso doivent être effectués après obtention d'une autorisation de l'Agence Nationale de l'Aviation Civile (ANAC) du BurkinaFaso et conformément à la réglementation nationale. 1 1.All flights into, over the territory of Burkina Fasoterritory shall be carried out in accordance with National Civil Aviation Agency of Burkina Faso(NCAA) after gaining authorization and in accordance with the national regulations.
2. Tout aéronef à destination du Burkina Faso doit effectuer son premier atterrissage en territoire burkinabè sur un aéroport international disposant des services de douane, de police et de santé. De même tout aéronef quittant le territoire burkinabè doit accomplir sa derniére escale sur un aéroport international en territoire Burkinabè disposant des services de douane, de police et de santé. (voir AD1.3). 2. Any aircraft bound for Burkina Faso must make its first landing in Burkina Faso territory at an international airport with customs, police and health services. Similarly, any aircraft leaving Burkinabe territory must make its last stopover at aninternational airport in Burkinabe territory with customs, police and health services. (see AD 1.3).

d'affrètement. 		7. Commercial air transport flights by foreign aircraft between two points within the national territory with landing (cabotage) are prohibited. However, a foreign air operator may be authorized to operate a domestic flight under the air operating permit of a national operator by means of a contract in accordance with the Order on Charter

Foreign aircraft used for humanitarian flights within the territory of Burkina Faso must hold an authorization issued by ANAC. This authorization may be one-off, temporary, or
permanent upon request submitted to the Ministry of Foreign Affairs. The authorization is issued by the Director General of ANAC after consulting the Ministries of Defense and Security. Aircraft used for humanitarian flights within the
territory of Burkina Faso may not under any circumstances carry out flights for remuneration.
10. Tous les étrangers atterrissant sur un aéroport du Burkina Faso se font assister par un organisme d’assistance en escale agréé par l’ANAC conformément au RAF 06.4. Seules les compagnies aériennes nationales peuvent être autorisées

Les aéronefs des états membres de l'UEMOA peuvent circuler librement au-dessus du territoire du Burkina Faso et réciproquement, sous réserve d'observer la réglementation en vigueur au Burkina Faso. 6 12 . Aircraft from WAEMU member states may circulate freely above the territory of Burkina Faso and viceversa, subject to observing the regulations in force in Burkina Faso.

Les aéronefs n'ayant pas la nationalité d'un état membre de l'UEMOA ne peuvent circuler au-dessus du territoire du Burkina Faso que si ce droit leur est accordé par une convention internationale ou s'ils reçoivent à cet effet, une autorisation spéciale et/ou temporaire. 7 13. . The aircraft registered else where may only fly over the territory of Burkina Faso if they have been granted this right through an international convention or if they obtain a special and/or temporary authorization.

La demande doit inclure les informations suivantes dans l'ordre indiqué ci-dessous Si un aéronef d'Etat a l'intention d'effectuer une (série de) vol(s) non régulier(s) vers le Burkina Faso, il doit en faire la demande au Gouvernement du Burkina Faso à travers le canal diplomatique pour l'autorisation d'effectuer une telle opération avant l'atterrissage ou le survol prévu. (g)Un certificat attestant qu'aucun matériel de guerre, tel que des armes, des munitions, des explosifs (à l'exception des explosifs d'évasion/d'aide), des piéces pyrotechniques (à l'exception des cartouches de signal de pistolet), des matières fissiles nucléaires, des gaz ABC, du matériel et des matériaux photographiques (qu'ils soient installés ou non) des appareils électroniques autres que ceux requis pour le fonctionnement normal de l'aéronef ne sont transportés par l'aéronef. 8 14 .1.2. Le transport d'armes, de munitions, unités armées et appareils photographiques n'est permis que sur autorisation spéciale. 8 14 .2.1. Vols Réguliers 8 14 .2.1. Regular flights
Pour les opérations de vols réguliers internationaux par des compagnies aériennes étrangéres à destination ou en transit au Burkina Faso, les exigences suivantes doivent être respectées : For international scheduled flight operations by foreign airlines to or in transit through Burkina Faso, the following requirements must be met :
(a)L'Etat de la compagnie aérienne doit étrepartie soit à l'Accord sur le transit des services aériens internationaux de 1944, soit à un accord bilatéral sur le transport aérien avec le gouvernement du BurkinaFaso ou doit avoir obtenu une autorisation spéciale envertu d'un accord ou d'un arrangement bilatéral. (a)The State of the airline must be a party either to the year 1944 Agreement on the Transit ofInternational Air Services, or to a bilateral air transport agreement with the Government of Burkina Faso or must have obtained a special authorization under a bilateral agreement orarrangement.
(b)La compagnie aérienne doit étre éligible poureffectuer les vols en vertu des dispositions d'unaccord bilatéral ou multilatéral auquel l'Etat de la compagnie aérienne et le Burkina Faso sont parties contractantes et doit avoir une autorisation d'exploitation pour opérer dans l'espace aérien du Burkina Faso. Les demandes de tels permis doivent être soumises au Directeur Général de l'ANAC du Burkina Faso au moins trois (03) mois à l'avance. Si un opérateur a l'intention d'effectuer une (série de vols non réguliers vers le Burkina Faso dans le but de prendre ou de décharger des passagers, du fret ou du courrier, il doit en faire la demande par écrit (par l'intermédiaire de l'agent local/prestataire de services opérationnels agréé par l'ANAC pour opérateurs étrangers non réguliers) au Directeur Général de l'ANAC et obtenir l'autorisation préalable d'effectuer ces opérations au moins 72 heures ouvrables avant la date d'arrivée prévue. (i)Toute autre information pouvant être requise par leDirecteur Général de l'Agence nationale de l'aviation civile. (i)Any other information that may be required by the Director General of the National Civil Aviation Agency.
NB : Le transport de métaux précieux, d'armes, de munitions de guerre, de marchandises dangereuses tel que les matériaux fissiles, radioactifs et infectieux nécessite une autorisation spéciale de l'état burkinabé. NB: The transport of precious metals, weapons, munitions of war, dangerous goods such as fissile, radioactive and infectious materials requires special authorization from the Burkinabe state.
9. Travail aérien 9. Aerial work
Les exploitants de travail aérien ne peuvent effectuer des travaux sur le territoire burkinabé que s'ils détiennent une autorisation délivrée par l'Agence Nationale de l'Aviation Civile. Aerial work operators can only carry out their operations in Burkina Faso if they hold an authorization issued by the National Civil.
10. Aéronefs télépilotes 10. Remotely piloted aircraft
Les aéronefs télépilotés évoluent dans l'espace aérien burkinabé conformément à la réglementation de l'aviation civile applicable au Burkina Faso. Remotely piloted aircraft operate in Burkinabe airspace in accordance with civil aviation regulations applicable in Burkina Faso.
10.1. Les aéronefs télépilotés d'une masse maximale au décollage supérieur à cent cinquante (150) kilogrammes doivent se conformer à la réglementation applicable aux aéronefs habités. 10.1. Remotely piloted aircraft with a maximum take-off weight greater than one hundred and fifty (150)kilograms must comply with the regulations applicable to manned aircraft.
10.2. L'utilisation des aéronefs autonomes (aéronefs non habités ne permettant pas l'intervention d'un pilote en temps réel pour gérer le vol) est interdite. 10.2. The use of autonomous aircraft(unmanned aircraft that do not allow the intervention of a pilot in real time to manage the flight) is prohibited.
10.3. Un aéronef télépiloté civil ne peut etre exploité pour des activités autres que le sport et le loisir au Burkina Faso que s'il est identifié par l'Agence nationale de l'aviation civile et qu'un certificat d'identification est délivré à son propriétaire ou à son représentant légal. 10.3. 10.4.
